Regarding Gift Basket and Floral designs, content and prices:
CONTENTS & DESIGN: where substitution becomes necessary, it will include a product of like or greater value. Gift Basket designs indicated are again subject to availability of container and ingredient products and special requests cannot necessarily be granted.
PHYSICAL, EMOTIONAL, PSYCHOLOGICAL RISK: As Creative Compliments™ is not a party to the production and/or preparation, of ingredient content as may be contained and/or attached to gifts purchased, Creative Compliments™ cannot assure and/or warrant, that attached and/or ingredient products and other content, were not produced in nut and/or soya free and/or other conditions and accordingly advise that unless expressly stated to the contrary on such products' notices and/or labeling, the purchaser, consumer and/or recipient should assume that they were produced, prepared, packaged or provided in the presence of, or in contact with, nuts and soya and possibly other ingredients, accordingly, Creative Compliments™ is not responsible nor liable, legally or otherwise, for any allergies to and or arising there from, or any reactions to and/or arising there from, food and ingredient products contained in, or attached to, purchased gifts, delivered or otherwise, as such responsibility rests solely with the purchaser, consumer and/or recipient, to mitigate all such risks through examinination of ingredient content and labeling prior to consumption and/or physical contact with same, so as to minimize and/or eliminate and/or avoid such consequences arising from physical contact and/or consumption of the ingredient products contained therein.
PRICES indicated vary with choice of ingredients and are subject to appropriate delivery charges
and any applicable taxes.
Cancellation, Delivery & Refunds:
Owing to inventory variations, local weather conditions and other complications as they might arise, from time to time, local delivery in either Saskatoon or Regina may not be possible in a timely manner. Accordingly, Creative Compliments™ reserves the right to ship your order from Saskatoon to Regina, or conversely Regina to Saskatoon, directly to the recipient or, in some cases, to that city's location for recipient pick up. In such event, charges for shipping directly to the recipient's delivery address will be equivalent to those applicable for local delivery.
As buildings are of a fixed location and individuals are mobile, deliveries are to the address provided by the sender and not necessarily to the intended individual, organization and/or business enterprise. Advance communication with the recipent to assure that they are able to receive the delivery is not customarily made unless the recipient is in premises necessitating that the recipient authorize access to the premises upon arrival of the delivery. Changes to a delivery address received during and/or after a failed delivery, may be subject to an additional delivery charge equivalent to the charges as applied for the initial delivery. Should no one be at the premises to facilitate delivery completion, in an effort to minimize additional redelivery charges, the delivery may be left with neighbouring premises should they be receptive.
From time to time, the need may arise to cancel an order you have placed with us. We understand that things can change and are most anxious to accommodate your wishes, however, in certain circumstances, depending on when you wish to cancel your order, we may have progressed so far as to have either already incurred costs or to even have the gift basket completed and irretrievably on the way to your recipient, whether being locally delivered or in the hands of a commercial carrier.
Accordingly, and with regret, we are unable to refund for certain already incurred costs which arise when items that are not normally in our inventory, need be acquired from other sources (we call these "out-purchases") so as to fulfill your chosen, or custom designed order. This includes items such as, but not limited to, most foods, fruit, alcohol, printed materials, i.e. magazines, puzzle books, etc., and any other such non-returnable items especially those subject to a health regulation. Such out-purchases necessitate that someone be dispatched to acquire them and for this there is an extra charge (an "out-purchasing fee") that applies which also is non-refundable.
Clearly, your cancellation can impact in many ways so we've established the following cancellation, delivery & refund Terms & Conditions accordingly:
#1. Cancellations and/or returns are only valid for consideration if, and when, received in writing, either by email or fax and within the prescribed time and circumstance limitations as specified below.
#2. "Business" days, as referred to herein, are days other than holidays, Saturdays and Sundays. "Calendar" days, as referred to herein, are all days including "business" days, holidays, Saturdays and Sundays.
#3. Cancellation and/or return of a same-day delivery order, or an order necessitating that it be placed in the hands of a commercial carrier that same day so as to assure a timely shipping arrival, and refund of any and/or all of the purchase price, will be permitted only at the sole discretion of Creative Compliments™. Should Creative Compliments™ permit such a cancellation, at minimum, a processing fee of 20% as well as any charges for delivery, packaging and processing for shipping, out-purchases as described above including applicable out-purchase fees and applicable taxes, may be deducted from the amount processed for refund. If any order is returned as undeliverable for any reason, the delivered value of the order, less any applicable handling and processing charges, less a two-way delivery/shipping charge, less a 20% restocking charge, less out-purchases as described above including applicable out-purchase fees and applicable taxes, will be refunded to the purchaser's credit card as provided. Additional delivery charges will apply should a change of delivery destination resulting in greater cost for delivery be requested by the recipient, the purchaser or necessitated by recipient's or purchaser's provision of inaccurate or incomplete delivery addressing information as well as the recipient's failure, or refusal, to accept delivery.
#4. Cancellation and/or return of any order having a next business day local delivery, or shipping arrival, must be received in writing no later than 3:00 p.m. (Saskatchewan time - CST) the day ordered and refund of any and/or all of the purchase price, will be permitted only at the sole discretion of Creative Compliments™. Should Creative Compliments™ permit such a cancellation, at minimum, a processing fee of 20% as well as any charges for delivery, packaging and processing for shipping, out-purchases as described above including applicable out-purchase fees and applicable taxes, may be deducted from the amount processed for refund. If any order is returned as undeliverable for any reason, the delivered value of the order, less any applicable handling and processing charges, less a two-way delivery/shipping charge, less a 20% restocking charge, less out-purchases as described above including applicable out-purchase fees and applicable taxes, will be refunded to the purchaser's credit card as provided. Additional delivery charges will apply should a change of delivery destination resulting in greater cost for delivery be requested by the recipient, the purchaser or necessitated by recipient's or purchaser's provision of inaccurate or incomplete delivery addressing information as well as the recipient's failure, or refusal, to accept delivery.
#5. Cancellation and/or return of any order having a local delivery or shipping arrival beyond next business day must be received in writing no later than 12:00 noon (destination city time) the "calendar" day following the day ordered and refund of any and/or all of the purchase price, will be permitted only at the sole discretion of Creative Compliments™. Should Creative Compliments™ permit such a cancellation and/or return, at minimum, a processing fee of 20% as well as any charges for delivery, packaging and processing for shipping, out-purchases as described above including applicable out-purchase fees and applicable taxes, may be deducted from the amount processed for refund. If any order is returned as undeliverable for any reason, the delivered value of the order, less any applicable handling and processing charges, less a two-way delivery/shipping charge, less a 20% restocking charge, less out-purchases as described above including applicable out-purchase fees and applicable taxes, will be refunded to the purchaser's credit card as provided. #6: Refund of any and/or all of the order purchase price, will be permitted only at the sole discretion of Creative Compliments™. Return of custom orders, in whole and/or in part cannot be approved. Any ordered items must first be approved for return by Creative Compliments™ and any such approved return must occur within seven (7) calendar days following the order pickup and/or delivery. In such cases where order return, in part or in whole, is approved by Creative Compliments™ such a return will be subject to, at minimum, a processing fee of 20% as well as any charges for delivery, packaging and processing for shipping or delivery, out-purchases as described above including applicable out-purchase fees and applicable taxes, may be deducted from the amount processed for refund. If any order is returned as undeliverable for any reason, the delivered value of the order, less any applicable handling and processing charges, less a two-way delivery/shipping charge, less a 20% restocking charge, less out-purchases as described above including applicable out-purchase fees and applicable taxes, will only be refunded to the purchaser's credit card as provided.
#7: The purchaser understands and agrees that Creative Compliments™ has no responsibility for the ordered goods provided, after they have been placed in the hands of courier or commercial carrier for subsequent delivery or shipping to their destination and accordingly, Creative Compliments™ will not be held liable, in any manner be it legal or otherwise, for any and/or all consequences that may or may not arise as a result of early or delayed delivery or non-delivery of, or damage to, the ordered goods.
#8: These order cancellation, delivery and refund Terms & Conditions, as specified herein, are deemed as understood and accepted by the purchaser upon submission of the purchaser's order be it verbally, written, through our website shopping cart and/or in any other manner, regardless of whether the purchaser has, or has not, indicated their prior understanding and acceptance in any other manner.
We trust you will understand that these charges reflect, and are proportionate to, the costs of the goods and services either acquired or expended by the time we receive notice of your cancellation and/or request for refund.
Under no circumstances will we sell, trade or otherwise distribute anything that you disclose to us in the course of your visit to our website.
We do maintain a computer record of the contact information you provide us, in our database, solely for the purposes of future marketing communication unless, you request that it be destroyed.
Additionally, and until systems prevail that are sufficiently secure as to instill complete consumer confidence, we may choose to communicate with you personally, by telephone, to acquire your credit card information. This information is available only to senior personnel and following your transaction with us, unless you request otherwise, the card number is immediately removed from our computer records and thereafter retained on hardcopy, in safekeeping, for not longer than as is required by the credit card company, and then destroyed.
Accordingly, each time you order from us, unless you request otherwise, it is necessary to once again provide your credit card particulars as we have no immediate means through which to reconstruct them.
